Supreme Court Rebukes Karnataka High Court Over Bail Decision

The Supreme Court has expressed strong disapproval of the Karnataka High Court’s decision to grant bail to actor Darshan Thoogudeepa, who is a key accused in the kidnapping, torture, and murder of 33-year-old Renukaswamy in June last year. The Supreme Court described the High Court’s action as a “prima facie perverse exercise of judicial power,” highlighting significant concerns over the judicial discretion exercised in this case.

Repeated Criticism from the Supreme Court

This marks the second instance within a week where the Supreme Court has criticized the Karnataka High Court regarding this matter. Previously, the High Court was admonished for failing to exercise proper discretion in granting bail to the actor. During a session, a bench comprising Justice JB Pardiwala and Justice R Mahadevan emphasized their intent not to repeat what they perceived as a mistake by the High Court, stating they would refrain from issuing judgments on conviction or acquittal at this stage.

Concerns Over High Court’s Language and Reasoning

The Supreme Court questioned the language used in the High Court’s December 2024 bail order, suggesting it resembled an acquittal rather than a bail decision. Justice Pardiwala expressed concern over the reasoning provided by the High Court, particularly regarding claims that “grounds of arrest were not furnished” in a murder case. The Supreme Court underscored that such reasoning was troubling and indicative of a misuse of judicial power.

Questions Raised About Trial Proceedings

The Supreme Court also raised questions about the trial proceedings after being informed that the trial would be conducted daily and completed within six months. Justice Pardiwala questioned why this case was receiving expedited attention while other accused individuals remained in prison for extended periods without trial.

Details of the Alleged Crime

Darshan Thoogudeepa, along with 13 others, faces charges related to Renukaswamy’s murder. The actor is accused of orchestrating the crime after Renukaswamy allegedly sent obscene messages to Pavithra Gowda, a friend of Darshan. Police investigations suggest that Darshan paid Rs 50 lakh to various individuals involved in planning and executing the crime, including arranging for Renukaswamy to be brought to Bengaluru.

Public Outrage and Controversies Surrounding Darshan

The case has sparked public outrage, particularly after Darshan skipped a court appearance citing back pain but was later seen attending a movie screening. Additionally, controversy arose when photos emerged showing Darshan and other accused individuals lounging and smoking inside jail premises. These incidents have fueled public anger and led to Darshan’s transfer to another facility.
