Texas Seeks Illinois Court’s Help to Arrest Democratic Lawmakers

Texas Pursues Legal Action Against Absent Lawmakers

The state of Texas is taking significant legal steps to address the absence of Democratic lawmakers who have left for Illinois, thereby breaking quorum and preventing a vote on redistricting during a special session. The Texas House of Representatives has filed a petition with the Eighth Judicial Circuit Court in Adams County, Illinois, naming itself as the petitioner and various state House members as respondents. This move aims to compel the return of these legislators to Texas.

Efforts to Secure Lawmaker Attendance

In response to the Democrats’ departure, the Texas House voted in favor of a motion allowing the sergeant-at-arms to retrieve lawmakers with unexcused absences. This includes issuing warrants for their arrest if necessary. Speaker of the House Dustin Burrows has issued civil warrants for those who deliberately broke quorum without valid reasons. The state is seeking Illinois’ cooperation in recognizing these warrants as a public act deserving full faith and credit.

Texas Attorney General’s Stance

Texas Attorney General Ken Paxton, who is currently running for U.S. Senate, has been vocal about holding these “rogue legislators” accountable. He emphasizes that Texans deserve representatives who fulfill their duties rather than fleeing at the behest of external influences. Paxton’s office has made it clear that all legal options are being considered to ensure these lawmakers return to Texas.

Speaker Burrows’ Determination

Speaker Burrows has reiterated his commitment to ensuring that his colleagues return to fulfill their constitutional responsibilities. Despite ample opportunities given to the absent lawmakers to return voluntarily, their continued refusal has led Texas to seek additional legal remedies from other states.
