Impact of California’s AB 5 on Independent Truckers

The introduction of Assembly Bill 5 (AB 5) in California has significantly disrupted the livelihoods of many independent truckers. For over three decades, I thrived as an independent contractor in the trucking industry, balancing my career with raising four daughters. However, the enactment of AB 5 in 2020 posed a severe threat to my business. This law imposed a rigid definition of employment, making it nearly impossible for small business truckers to operate independently within the state. Faced with the potential collapse of my business, I made the difficult decision to leave California.

The Broader Impact on Independent Contractors

The repercussions of AB 5 extend beyond individual truckers like me. Thousands across the country, including women, veterans, immigrants, and first-generation business owners, watched with apprehension. The ability to choose our work schedules and methods is not merely a convenience; it is essential for our survival. The law’s one-size-fits-all approach disregarded the unique nature of independent contracting.

Legislative Efforts to Protect Independent Workers

In response to the challenges posed by AB 5, Republican California Rep. Kevin Kiley introduced the “Modern Worker Empowerment Act.” This legislation aims to restore a consistent and sensible definition of independent work, allowing truckers to continue building their businesses without being forced into outdated employment models. The bill passed out of committee in the House of Representatives in late July, marking a significant victory for independent contractors.

A Hopeful Future for Independent Truckers

Rep. Kiley’s efforts highlight the importance of protecting independent contractors’ rights to dignity, autonomy, and fairness. By addressing the issues caused by AB 5 in California, he seeks to prevent similar mistakes nationwide. Running my trucking business allowed me to maintain flexibility and control over my work-life balance, serving as a role model for women in the industry. With this new legislation, there is hope that I may one day return to California and continue my business under fairer conditions.
