Chief Justice Rebukes Lawyer for Informal Reference to Judge in Cash Scandal

In a recent Supreme Court session, Chief Justice of India BR Gavai reprimanded Advocate Mathews Nedumpara for referring to Justice Yashwant Varma as merely “Varma.” This incident occurred during a hearing concerning a petition filed by Mr. Nedumpara, who is seeking an FIR against Justice Varma following a significant cash recovery from the judge’s residence. The Chief Justice questioned the lawyer’s informal address, emphasizing that Justice Varma remains a respected member of the judiciary.
The controversy surrounding Justice Yashwant Varma began in March when a fire at his home led to the discovery of a substantial amount of cash. At the time, Justice Varma was serving at the Delhi High Court before being transferred to the Allahabad High Court. The incident prompted an inquiry by a Supreme Court panel, which found him guilty of misconduct. Subsequently, then Chief Justice Sanjiv Khanna recommended impeachment proceedings against him, a decision that Justice Varma has contested in the Supreme Court.
Advocate Mathews Nedumpara has been persistent in his efforts to secure an urgent hearing for his petition, which he has now moved for the third time. His petition calls for the Delhi Police to register an FIR against Justice Varma, arguing that the cash recovery constitutes a cognizable offense under the Prevention of Corruption Act and anti-money laundering laws. The petition highlights that despite evidence collected by police officers at the scene, no FIR was registered due to legal constraints requiring permission from the Chief Justice of India.
Mr. Nedumpara’s petition also challenges the constitutionality of the Supreme Court’s three-member inquiry committee, claiming it oversteps into police jurisdiction. He argues that such inquiries should not interfere with law enforcement duties and calls for adherence to established legal procedures.
