Activist Seeks Compensation for Detention

Pro-Palestinian activist Mahmoud Khalil has filed a claim against the U.S. government, seeking $20 million in damages after being detained by the Trump administration. Khalil, who was targeted for deportation, argues that his detention was unjust and seeks to use the compensation to aid others similarly affected and support Columbia University. The Center for Constitutional Rights highlighted that Khalil would accept an official apology and the cessation of what he describes as unconstitutional policies in lieu of monetary compensation.

Legal Action Under Federal Tort Claims Act

The claim serves as a precursor to a federal lawsuit under the Federal Tort Claims Act, a statute from 1946 that permits individuals to sue the U.S. government for civil law violations. Khalil’s legal action aims to hold the Trump administration accountable for what he perceives as wrongful detention practices. During his detention, Khalil missed significant personal milestones, including the birth of his first child, which he cites as part of the trauma endured.

Accusations Against Israel and U.S. Policy

Khalil has been vocal about his accusations against Israel, alleging genocide in Gaza. He criticizes the U.S. government for using taxpayer dollars to support these actions, linking his detention to his outspoken stance on these issues. Khalil’s statement emphasizes the need for accountability and justice for those targeted due to their political views.

DHS Defends Actions

In response, Department of Homeland Security Assistant Secretary Tricia McLaughlin dismissed Khalil’s claims as baseless. She asserted that Khalil’s behavior on campus branded him as an antisemite and justified his detention under U.S. immigration laws. McLaughlin emphasized that obtaining a visa or green card is a privilege and that the Trump administration acted within its legal rights to detain individuals posing threats or advocating violence.

Ongoing Legal Proceedings

A senior State Department official confirmed ongoing litigation regarding this matter, maintaining that the actions taken against Khalil were lawful and necessary. The official reiterated the government’s commitment to using all legal measures to address violations of U.S. laws and protect citizens.
