Jagdeep Dhankhar’s Key Rajya Sabha Remarks Before Resignation

Hours before his resignation, Vice President and Rajya Sabha Chairman Jagdeep Dhankhar addressed the House regarding a significant judicial motion. He informed members about receiving a notice to form a statutory committee for the removal of Justice Yashwant Varma. This motion, signed by over 50 members of the Council of States, met the necessary requirements to initiate the process for a high court judge’s removal.
Dhankhar directed the secretary-general to verify if a similar motion had been moved in the Lok Sabha. Under the Judges (Inquiry) Act, 1968, different procedures apply depending on whether a motion is presented in one or both Houses. If presented on different dates, only the first motion is considered. However, if presented on the same day, both Houses must admit it for further action.
In cases where motions are presented simultaneously in both Houses, neither the Speaker nor the Chairman can unilaterally admit or reject them. Instead, these motions become the property of Parliament. Dhankhar highlighted Section 3(2) of the Judges (Inquiry) Act, which mandates forming a committee to investigate the grounds for a judge’s removal if a motion is admitted.
Earlier in the session, Dhankhar emphasized reducing political acrimony and fostering mutual respect among parties. He urged political leaders to avoid personal attacks and focus on constructive dialogue. Stressing India’s historical strength in discourse and deliberation, he called for cooperation to ensure a productive Monsoon Session.
Dhankhar’s remarks underscored the importance of procedural clarity in judicial matters and advocated for political harmony. His call for constructive politics aims to guide India towards greater progress during this parliamentary session.
