Judge Orders Extended Hearings Amid Deportation Dispute

U.S. District Judge Paula Xinis has mandated an additional day of court hearings in the case of Salvadoran migrant Kilmar Abrego Garcia. The decision comes as she evaluates the next steps in the civil proceedings, particularly concerning efforts by Abrego’s legal team to prevent his deportation to a third country. The Trump administration plans to deport him as early as next week. Despite objections from Justice Department lawyers, who cited scheduling conflicts, Judge Xinis insisted on continuing the hearings, criticizing the government’s witness for lacking knowledge.

Criticism of Government Witness Testimony

During the proceedings, Judge Xinis expressed dissatisfaction with the testimony of Thomas Giles, an assistant director at ICE. Giles was expected to provide detailed information about Abrego Garcia’s case and the government’s deportation plans. However, his testimony was deemed inadequate due to his limited familiarity with third-country removals and lack of direct involvement in such cases for nearly two decades. This prompted Judge Xinis to schedule further questioning.

Judge Xinis also hinted at the possibility of issuing a temporary restraining order to ensure that Abrego Garcia remains in local immigration detention facilities and is not moved without access to legal counsel. She emphasized the need for assurances regarding his custody status if released from U.S. custody in Tennessee.
