Kayla, who was only 20 years old, was brutally assaulted and killed in 2022 by Walter Javier Martinez, a 17-year-old illegal migrant in the U.S. under Unaccompanied Alien Child (UAC) status. Martinez was sentenced to 70 years in prison this April for his crimes. Nobles believes that the proposed legislation could have prevented her daughter’s death and is advocating for its passage to protect other families from similar tragedies.
Congressman Russell Fry of South Carolina has introduced the Kayla Hamilton Act, named in honor of Nobles’ daughter. This bill aims to enhance the vetting process for UACs entering the United States. It mandates that the U.S. Department of Health and Human Services (HHS) evaluate whether these minors pose a threat to themselves or their communities. The bill seeks to ensure that background checks are conducted before UACs are released into the community, potentially identifying gang affiliations or criminal histories that could pose risks.
Under existing laws, UACs who enter the U.S. without a parent or legal guardian are placed under the care of the Office of Refugee Resettlement (ORR) within HHS. They are not immediately deported, which has raised concerns about public safety. The Kayla Hamilton Act proposes stricter protocols, requiring HHS to contact foreign consulates or embassies to verify any criminal background or gang ties of these minors. It also mandates screening for gang tattoos and ensures that those with known affiliations are housed in secure facilities rather than being released into communities.
Rep. Fry emphasizes that this legislation is crucial for restoring accountability and safeguarding American communities. He argues that Kayla’s murder was preventable had proper vetting protocols been enforced by the current administration.
