Senator Tom Cotton, a prominent Republican and chair of the Senate Intelligence Committee, has called for an investigation into former Special Counsel Jack Smith. Cotton alleges that Smith unlawfully attempted to influence the 2024 presidential election against Donald Trump. In a letter addressed to Jamieson Greer, the acting head of the Office of Special Counsel, Cotton urged the Justice Department to consider prosecuting Smith for his actions under the Biden administration. Cotton’s accusations center around several instances where he believes Smith expedited legal proceedings without legitimate cause. He cited four specific examples during Smith’s tenure, including the fast-tracking of trial dates and jury selection related to Trump’s August 2023 indictment. This indictment involved charges such as conspiracy to defraud the United States and obstruction of an official proceeding. Cotton argues that defendants typically have more than two years to prepare for such trials, yet jury selection was scheduled just weeks before the Iowa Caucuses in 2024.
The senator also criticized Smith for allegedly bypassing normal appellate processes and failing to provide valid reasons for expedited court reviews. Cotton highlighted Smith’s actions following a Supreme Court decision on presidential immunity, which he claims violated the Justice Department’s “60-day rule” meant to prevent prosecutorial actions that could impact upcoming elections. Cotton noted that Smith’s brief exceeded standard length limits and included grand jury testimony usually kept confidential.
Cotton argues that these actions were not standard or justified unless intended to influence election outcomes. He emphasized that despite Trump’s victory over Biden, it does not absolve Smith of accountability for alleged unlawful conduct. The senator has requested a thorough investigation by the Office of Special Counsel to determine if Smith or his team acted with political motives.
