In a significant legal victory for the Dravida Munnetra Kazhagam (DMK), the Supreme Court has overturned a Madras High Court interim order that restricted the use of Tamil Nadu Chief Minister MK Stalin’s name in state-run welfare schemes. This decision comes as a relief to the ruling party, especially with the upcoming Assembly elections where the DMK and its ally, Congress, will face off against the All India Anna Dravida Munnetra Kazhagam (AIADMK) and Bharatiya Janata Party (BJP).

The Supreme Court’s decision is crucial for the DMK as it allows them to continue associating their welfare initiatives with their party leader, a strategy commonly employed by political parties across India. The inability to do so could have potentially weakened their campaign efforts in the forthcoming elections.

Reprimand for AIADMK MP C Ve Shanmugam

The court also criticized AIADMK MP C Ve Shanmugam for filing a petition that appeared to target the DMK specifically. Chief Justice BR Gavai highlighted that Mr. Shanmugam’s actions were an abuse of legal processes, aimed at settling political scores rather than addressing genuine legal concerns. Consequently, Mr. Shanmugam was ordered to pay Rs 10 lakh to cover legal costs, with instructions for the funds to be used to aid the underprivileged.

Political Leaders’ Names in Welfare Schemes: A Common Practice

The Supreme Court acknowledged that naming welfare schemes after political leaders is a widespread practice in India, citing numerous instances within Tamil Nadu alone. However, it refrained from listing these examples to prevent any embarrassment.

Legal and Political Reactions

Senior advocates Mukul Rohatgi and Abhishek Singhvi defended the DMK’s position, arguing that there are no legal precedents prohibiting such practices. They also pointed out similar actions by the AIADMK in the past, using former Chief Minister J Jayalalithaa’s name for various schemes. This ruling underscores the complex interplay between law and politics in India, highlighting how legal decisions can significantly impact electoral strategies and party dynamics.
