Supreme Court Orders Divorce, Man to Transfer Rs 4 Crore Flat to Ex-Wife

Supreme Court Grants Divorce and Property Settlement

The Supreme Court has finalized a divorce between an estranged couple, mandating the transfer of a Rs 4 crore flat in Mumbai from the husband to the wife. This decision was made by a bench led by Chief Justice of India B R Gavai, alongside Justices K Vinod Chandran and N V Anjaria. The court also dismissed criminal charges against the husband under Sections 498-A and 406 of the IPC, citing lack of specific evidence.

Irretrievable Breakdown of Marriage

The court noted that the couple’s relationship had been strained for over eight years, with numerous legal battles indicating an irreparable breakdown. The bench invoked Article 142 of the Constitution to dissolve the marriage, emphasizing that it was in the best interest of both parties to move forward.

Property Transfer and Financial Obligations

The court ordered the husband, a former banker, to cover maintenance charges for the apartment until September 1, 2025. He must execute a gift deed by August 30, 2025, transferring ownership of the flat to his ex-wife. Both parties are required to be present for the deed’s registration; failure to comply could affect the divorce’s finalization.

Closure of Legal Proceedings

All civil and criminal proceedings related to the marriage have been closed by the court. The bench stated that no further legal actions should be initiated by either party concerning their dissolved marriage.
