US Lawyer Highlights Delays in Air India Crash Compensation

The lead US attorney, Mike Andrews, representing over 65 families affected by the tragic AI171 plane crash, has voiced strong criticism over the prolonged delays in compensation for the victims’ families. Andrews emphasized that such bureaucratic hurdles would not have existed if Ratan Tata, the former Chairperson of the Tata Group, were still alive. Speaking to ANI on Sunday, Andrews praised Tata’s legacy of compassion and suggested that his presence could have expedited the compensation process for grieving families.

Ratan Tata’s Legacy and Its Impact on Compensation Delays

Andrews noted that even in the United States, Ratan Tata is recognized for his work ethic and dedication to employee welfare. He expressed confidence that if Tata were present today, the victims and their families would not be subjected to such a lengthy bureaucratic process. Andrews highlighted a particularly distressing case involving a bedridden elderly mother who lost her only son, her sole financial provider, in the crash. This case underscores the urgent need for timely compensation to support those left vulnerable by the tragedy.

Legal Avenues and Potential Claims

On Friday, Andrews outlined potential legal avenues based on findings from the flight data recorder and cockpit voice recorder. If a defect in the aircraft, such as issues with the FADEC system or throttle control, is identified as a cause of the crash, a product liability claim could be filed in the US. Alternatively, if Air India is found responsible, claims would likely fall under the Montreal Convention.

Interim Compensation and Memorial Initiatives

On July 26, Air India released Rs 25 lakh in interim compensation payments to families of 147 passengers and 19 others who lost their lives on the ground. These payments will be adjusted against final compensation amounts. The Tata Group has also established ‘The AI-171 Memorial and Welfare Trust’ to honor victims. The Trust has pledged an ex gratia payment of Rs 1 crore for each deceased individual and supports rebuilding efforts at BJ Medical College Hostel, which was damaged in the accident.

Tragic Details of the AI171 Crash

On June 12, Air India flight AI171 crashed shortly after takeoff from Ahmedabad’s Sardar Vallabhbhai Patel International Airport, resulting in 260 fatalities, including passengers, crew members, and individuals on the ground. The Aircraft Accident Investigation Bureau of India released a preliminary report detailing how both engines unexpectedly shut down during initial climb, leading to a catastrophic loss of thrust and rapid descent.
